1. General Information
(1) This website ("www.seconddreamdate.com") and/or the services, including all related mobile applications ("Services"), and all offers and sales of products ("Products") through the website, are owned and operated by Second Dream Date (Founder & Dream Date Planner: Lisa Feichtinger). These terms and conditions ("Terms") set out the conditions under which visitors or users ("Users" or "You") may visit or use the website and/or services and purchase products.

(2) By accessing or using the Services, you agree to these Terms and are bound by them. If you do not agree with all the Terms, you may not access the website or use the Services. Please read these Terms carefully before accessing our website, using the Services, or purchasing Products. These Terms explain who we are, how we sell Products to you, how you can withdraw from the purchase agreement, and what you can do in case of problems.

(3) You represent that you are of legal age and have the legal authority, right, and freedom to enter into a binding agreement based on these Terms and to use the Services and purchase Products. If you are a minor, you must have the permission of your parents or a legal guardian to use the Services or purchase Products.
 

2. Scope of Services
(1) Second Dream Date acts as an event planner and travel facilitator. We organize and coordinate luxury experiences on your behalf, including but not limited to transportation, activities, dining, and accommodation.
(2) While we aim to provide accurate information about the experiences and services offered, these are subject to the terms and conditions of the respective third-party providers.

3. Liability Disclaimer
(1) Third-Party Providers: Second Dream Date acts as a travel/event agency and intermediary for third-party providers. We are not liable for the execution of services by third-party providers, including but not limited to transportation companies, venues, activity providers, and dining establishments.

(2) Accidents or Incidents:
We are not responsible for any incidents, accidents, injuries, loss, or damage that may occur during any part of the experience. Responsibility for such occurrences rests with the respective third-party providers.

(3) Force Majeure:
We are not liable for delays, cancellations, or disruptions caused by events beyond our reasonable control, such as natural disasters, strikes, pandemics, or government actions.

(4) User Responsibilities:
Users are responsible for ensuring they are physically and medically fit to participate in any activities. It is also the user's responsibility to disclose any dietary restrictions, allergies, or special requirements in advance.

4. Booking and Payment
(1) All bookings are subject to availability. Payment is required to confirm your booking.
(2) Prices are inclusive of VAT unless explicitly stated otherwise.
(3) Refund and cancellation policies are outlined in the separate Refund Policy, available on our website.
 

5. User Data Protection
(1) We comply with the General Data Protection Regulation (GDPR) and Spain's Organic Law 3/2018 on the Protection of Personal Data and Guarantee of Digital Rights. Your personal information will be collected, processed, and stored securely.
(2) Detailed information about how we handle your data can be found in our Privacy Policy.
 

6. Intellectual Property
(1) All content, including but not limited to text, images, videos, and graphics, on this website is owned by or licensed to Second Dream Date and is protected under Spanish copyright law.
(2) Unauthorized use, reproduction, or distribution of this content is strictly prohibited.

7. Governing Law and Jurisdiction
(1) These Terms are governed by the laws of Spain.
(2) Any disputes arising from or in connection with these Terms will be subject to the exclusive jurisdiction of the courts in Málaga, Spain.

8. Cancellation Policy

(1) Cancellation by the Client:

  • All cancellations must be submitted in writing via email to info@seconddreamdate.com.

  • Cancellation Fees:

    • Cancellations made 30 days or more before the scheduled experience date will receive a refund of 100% of the total package price, minus a processing fee of €100.

    • Cancellations made less than 30 days but more than 10 days before scheduled date will receive a refund of 50%, minus a processing fee of €100.

    • Cancellations made less than 10 days before the scheduled date are non-refundable.

(2) Rescheduling Requests by the Client:

  • Rescheduling is allowed only if requested 30 days or more before the scheduled date, subject to a €150 rescheduling fee.

  • Rescheduling requests made less than 30 days before the scheduled date will be treated as a cancellation, and no refund or rescheduling will be provided.

(3) Cancellation or Changes by Second Dream Date:

  • We reserve the right to cancel, reschedule, or modify an experience due to unforeseen circumstances, such as:

    • Extreme weather conditions.

    • Unavailability of third-party providers.

    • Other force majeure events.

  • In such cases, we will:

    • Offer an alternative date for the experience, or

    • Provide a refund of 100% of the total package price (processing fees and third-party charges may apply).

(4) No-Shows:

  • Failure to attend the scheduled experience will result in no refund or rescheduling under any circumstances.

(5) Refund Process:

  • Approved refunds will be processed within 14 business days.

  • Processing fees and third-party provider charges are non-refundable.
